Smart charge point regulations, explained

New domestic charge points have had to be smart since 30 June 2022. That single rule is why your unit arrives pre-set to charge overnight, and why it can sit there for up to ten minutes before anything happens.

What the regulations require

The Electric Vehicles (Smart Charge Points) Regulations 2021 came into force on 30 June 2022. From that date, any new domestic or workplace charge point has to be smart. This is not a premium feature or a manufacturer's marketing line. It is a legal minimum, and it is why every unit you can buy today behaves in broadly the same way out of the box.

  • The charge point must be smart. It has to be capable of sending and receiving information, and of responding to a charging schedule rather than simply passing current the moment a car is plugged in.
  • It must arrive pre-configured with default off-peak charging hours. The unit is set to charge outside peak periods before you ever open the app.
  • Those default hours must be adjustable. You can change them, and you can charge whenever you want. The default is a starting position, not a lock.
  • It must apply a randomised delay of up to ten minutes. The delay is applied at the start of a charging schedule, and again after an interruption.

Non-smart chargers are not an option any more

A legacy dumb unit cannot legally be newly installed. If a quote offers you a cheaper non-smart charger, that is a compliance problem rather than a bargain, and it is a reason to look at who is doing the quoting.

Default off-peak hours, and how to change them

Your charger comes out of the box already scheduled to charge at off-peak times, and you are free to move that schedule. The reason to leave it broadly where it is comes down to money rather than compliance: overnight EV rates currently sit at roughly 6.99p to 9p per kWh against a capped average unit rate of 26.11p, a discount of around 65 to 73 per cent. Two schedules have to agree

Your charger holds one schedule and your tariff holds another. If the charger is set to start at 11pm and your cheap window opens at midnight, you pay peak rate for the first hour every night. Some chargers avoid this entirely by taking the schedule from the supplier: Ohme units pair directly with Intelligent Octopus Go so the tariff sets the slots, and smart charging dispatched outside the published window is still billed at the off-peak rate.

The randomised delay, and the ten minutes of nothing

The delay is the part that generates the most support calls. You plug in at 23:30, the schedule says charge, and nothing happens for several minutes. The unit is not faulty. It is applying the randomised delay the regulations require, capped at ten minutes, before it starts drawing current.

The purpose is coordination. If every charge point on a street, a town or a national tariff started at exactly 00:00:00, the grid would take a step change in demand at the same instant every night. Spreading the starts across a random window of up to ten minutes smooths that. The delay applies again after an interruption, so a brief power cut mid charge means another short pause before the session resumes rather than an instant restart. It does not reduce the energy delivered, only the moment the session begins.

Who is allowed to fit one

Charger installation is notifiable electrical work. It has to be carried out by a registered competent person under a scheme such as NICEIC or NAPIT, or notified to your local building control directly. You should finish the job holding an electrical installation certificate and confirmation that the notification was made. Skipping that paperwork is the sort of thing that surfaces at the point of sale or on an insurance claim, years later.

Separately, your Distribution Network Operator has to know. Most domestic single phase chargers follow a connect-and-notify route, where the installer fits the unit and notifies the DNO afterwards, typically within 28 days. County pages on this site name the network operator for your area and carry a local calculator for running the numbers on your own usage, and you can reach yours from the coverage map.

New builds, flats and Part S

Part S of the Building Regulations has applied in England since 15 June 2022. A new home with associated parking has to be built with an EV charge point of at least 7kW, or with a cable route where a charge point is not feasible. Blocks of flats with shared parking need charge points across a minimum share of the spaces, plus cable routes for the rest. If you are buying new and the plot has parking, the charge point provision is a question for the developer rather than an aftermarket job.

What the rules leave to you

  1. Which charger you buy. Smart is the floor, not the ceiling. Tariff integration, solar surplus tracking and cable format vary widely between units, and none of that is mandated. Our EV charging guidance covers the differences that actually change your bill.
  2. Which tariff you sit on. The regulations set the charger's default behaviour, not your rate. A whole home off-peak tariff and an EV-only add-on produce very different bills for the same car.
  3. Whether you charge from your own generation. Surplus-aware charging from solar is a manufacturer feature, not a legal requirement, and it interacts with a home battery competing for the same surplus.
  4. Whether a grant applies. The chargepoint grant covers renters, flat owners and landlords, plus households with only on-street parking using an approved cross-pavement solution. The cap rose from £350 to £500 per socket on 1 April 2026, and an approved installation team is a condition of claiming it.

Smart charging rules, answered

Do smart chargers have to charge off-peak by default?

Yes. The Electric Vehicles (Smart Charge Points) Regulations 2021 require every new domestic and workplace charge point to arrive pre-configured with default off-peak charging hours. Those hours are adjustable, so you can change the schedule or charge on demand whenever you need to. The default exists so that a charger left untouched does not add load at the busiest times of day.

Why does my EV charger wait before it starts charging?

It is applying the randomised delay that the regulations require. The delay is capped at ten minutes and is applied at the start of a charging schedule, and again after an interruption such as a brief power cut. Spreading start times stops large numbers of chargers switching on at the same instant. It delays the start of the session, not the amount of energy you end up with.

Can I turn the randomised delay off?

No. It is a requirement of the regulations rather than a manufacturer setting, so it is not something to disable in an app. In practice it costs you nothing, because ten minutes at the front of a six or seven hour overnight window does not change how full the car is by morning. If you need charge in a hurry, most units carry a boost or fast mode that overrides the schedule; on the Zappi the three modes are ECO, ECO plus and FAST.

Can I still buy a non-smart EV charger?

Not for a new domestic or workplace installation. Since 30 June 2022, legacy non-smart units cannot legally be newly installed. Existing installations fitted before that date are unaffected, but any replacement or new charge point has to meet the smart requirements.

Does a new build house have to come with an EV charge point?

In England, Part S of the Building Regulations has required it since 15 June 2022. A new home with associated parking needs a charge point of at least 7kW, or a cable route where a charge point is not feasible. Blocks of flats with shared parking need charge points across a minimum share of spaces plus cable routes for the remainder.

Do the smart charging rules mean my charger will only work overnight?

No. The default schedule is a starting position that you can change at any time, and nothing in the regulations restricts when you are allowed to charge. The reason most people leave the overnight schedule broadly alone is cost: overnight EV rates currently run around 6.99p to 9p per kWh against a capped average unit rate of 26.11p.
